The December 31, 2026 Florida Residency Deadline Explained
Amendment 3 rewards people who are permanent Florida residents by December 31, 2026. Here is how to establish residency in time and plan a closing around it.
Under Amendment 3, approved by about 62% of Florida voters on November 3, 2026 (unofficial count), people who are permanent Florida residents on or before December 31, 2026 qualify for the larger homestead exemption of up to $150,000 of assessed value in 2027 and $250,000 in 2028 on non-school taxes, while later arrivals wait until their fifth year of homestead (Leon County Property Appraiser, November 2026). As of November 6, 2026, 55 days remain, so the safest plan is to get a Florida driver license, register your vehicle, register to vote and, if you are buying, close and move in before December 31, then file homestead by March 1, 2027.

What is the December 31, 2026 residency deadline?
It is the date in Amendment 3 that separates people who get the larger homestead exemption right away from new residents who start smaller. Florida residency on or before December 31, 2026 is the test.
The amendment takes effect January 1, 2027. Qualifying homesteads get up to $150,000 of assessed value exempt from non-school levies in 2027 and up to $250,000 in 2028, indexed to inflation from 2029 (ClickOrlando, November 4, 2026; Florida Senate, June 2, 2026). People who establish residency on or after January 1, 2027 start with roughly today's level of exemption, described by the Leon and Volusia County Property Appraisers as $50,000 for non-school taxes, and become eligible for the larger exemption beginning in the fifth year of homestead.
School taxes and non-ad valorem assessments are not reduced for anyone (Leon County Property Appraiser, November 2026). For the full tax picture, read what Amendment 3 means for buyers.
Do I have to own a Florida home by December 31, 2026?
Not necessarily, according to two property appraisers, but sources word it differently, so owning and living in the home by December 31 is the most protective plan.
The Leon and Volusia County Property Appraisers say a person who is a permanent Florida resident by December 31, 2026 and buys later, for example a renter who buys in 2027 or 2028, qualifies for the higher amount when they apply for homestead. Henderson Franklin, a Fort Myers law firm, described the larger exemption as applying to "Florida residents with homestead property by December 31, 2026" (September 29, 2026). The Manatee County Property Appraiser says it is verifying that owners meet Florida residency requirements as of December 31, 2026.
So a renter who truly moves here by December 31 should document it carefully, and a buyer who closes, moves in and establishes residency by then satisfies every reading and can file for 2027 homestead by March 1, 2027.
How do I establish Florida residency before December 31?
Move here, then build a consistent paper trail: a Florida driver license, Florida vehicle registration, voter registration and, if useful, a declaration of domicile, all showing your Florida address.
The Florida Department of Highway Safety and Motor Vehicles (FLHSMV) requires a Florida driver license within 30 days and vehicle title and registration within 10 days of establishing residency. It says starting work here, registering to vote or filing for homestead can make you a resident.
| Step | Where | Timing or cost | Source |
|---|---|---|---|
| Florida driver license or ID card | Lee or Collier County Tax Collector, by appointment | Within 30 days of residency; you surrender your old license | FLHSMV; Lee County Tax Collector |
| Florida insurance, title and vehicle registration | County Tax Collector | Within 10 days of residency; $225 initial registration fee for vehicles new to Florida | FLHSMV; s. 320.072, F.S. |
| Voter registration at your Florida address | RegisterToVoteFlorida.gov, Tax Collector or Supervisor of Elections | No fee | Florida Division of Elections |
| Declaration of domicile | Clerk of the Circuit Court in your county | Sworn, notarized and recorded; small recording charge | s. 222.17, F.S.; s. 28.24, F.S. |
| Homestead application (Form DR-501) | Lee or Collier County Property Appraiser | Own and occupy on January 1, 2027; file by March 1, 2027 | Lee County Property Appraiser |
The Lee County Property Appraiser may request a Florida license or ID, vehicle registration and voter registration showing the property address, and if needed a declaration of domicile, employer, tax return address and utility records. Applicants need a Social Security number (and a spouse's, if married) and U.S. citizenship or permanent residency.
Book Tax Collector appointments now. Thanksgiving falls on Thursday, November 26 and Christmas on Friday, December 25, 2026, and government offices generally close for both, which shortens the calendar.
What is a declaration of domicile and should I file one?
A declaration of domicile is a sworn statement, recorded with the county clerk under section 222.17 of the Florida Statutes, that Florida is your permanent home. It supports your residency claim but does not replace a license, registration or voter record.
You swear that your home in that county is your permanent home and list where you lived before and any other homes you keep. It is notarized and recorded. The clerk's charge comes from section 28.24, which sets recording at $5 for the first page plus state surcharges; confirm the current total with the Lee or Collier County Clerk.
The Manatee County Property Appraiser tells applicants who cannot get a Florida license and registration by December 31, 2026 to file a declaration of domicile with the Clerk and send a recorded copy, and adds that the declaration does not remove the need for the other documents. Kaufman Rossin also recommends documenting the move with a driver license, voter registration and declaration of domicile. Filing before December 31 is a low-cost way to date your intent on the public record.
Can I close on a home in time for December 31?
Yes, if you are under contract by about mid-November for a financed purchase or early December for cash, since financed single-family buyers across the eight MLS areas we track closed a median 36 days after contract over the past 12 months and cash buyers 31 days (Cameron Smith analysis of MLS data, 12 months to October 2026). The tight spots are appraisal, insurance and condo documents.

| All 8 areas | 31 | 36 | 31 | 38 |
| Cape Coral | 26 | 35 | 28 | 36 |
| Fort Myers | 35 | 36 | 30 | 37 |
| Lehigh Acres | 21 | 35 | 25 | 33 |
| North Fort Myers | 29 | 34.5 | 28 | 37 |
| Estero | 35 | 40 | 31 | 38 |
| Bonita Springs | 34 | 39 | 32 | 39 |

Financed condo purchases ran longest, a median 38 days, so condo buyers using a loan should aim for the earlier end of the contract window.
How these numbers were measured. Figures come from closed MLS sales and listings in Southwest Florida MLS, pulled November 6, 2026. Each city follows the MLS City field. Estero includes Miromar Lakes, Fort Myers covers only the city limits and downtown MLS areas (unincorporated Fort Myers mailing addresses are left out), and Naples is the Naples postal city on the Collier mainland, with Marco Island counted separately. Single-family means detached homes and detached villas that are not condo owned. Condo and townhouse covers condo-owned units in low, mid and high rise buildings, attached villas and townhouses. Manufactured homes, co-ops, timeshares, land and rentals are excluded. Sales under $20,000 or below 50% or above 150% of list price were dropped, and sales entered after the fact without MLS marketing count toward prices but not toward days or sale-to-list figures. Days list to contract runs from the listing date to the first pending date. Months of supply is active listings at period end divided by average monthly closed sales over the prior 12 months. Flood zone is not in the MLS export, so any flood zone figures on this page come from FEMA or county sources. Days to close by cash or financed buyer were computed from the listing-level MLS file with the same cleaning rules. The pull cannot show which active listings could close by December 18, since that depends on vacancy, seller timing and financing.
The 30-year fixed averaged 7.18% on November 5, 2026, up from 6.22% a year earlier (Freddie Mac), so payment math is tight and lock timing matters. Here is the backward calendar I use with buyers aiming for the line, assuming normal underwriting.
| Milestone | Financed purchase | Cash purchase |
|---|---|---|
| Pre-approval or proof of funds in hand | Now | Now |
| Insurance quotes, including flood, before the offer | Before you write | Before you write |
| Contract signed | By Friday, November 13 to 20 | By Tuesday, December 1 |
| Inspection period ends | About 10 days after contract | About 7 to 10 days after contract |
| Target closing | By Friday, December 18 | By Friday, December 18 |
| Move in, then license, tag and voter changes | December 18 to 24 | December 18 to 24 |
Targeting December 18 leaves room before the Christmas closures. Condo buyers should add time: resale buyers get 7 days to review association documents under HB 913 (Governor's office, June 23, 2025), and the condo buyer checklist explains what to read. Citizens will require flood coverage on all wind-covered personal residential policies starting January 1, 2027 (Citizens Property Insurance), so read the 2027 flood rule before you shop. To see what can close in time, search current listings.
What happens if I miss the December 31 deadline?
You can still homestead a Florida home, but you start with the smaller exemption and wait until your fifth year of homestead for the larger one.
Sources describe the new-resident path differently. The Leon and Volusia appraisers describe a $50,000 non-school exemption at first; the Florida Senate release describes $50,000 for four years; the Florida Chamber timeline says new residents begin qualifying after January 1, 2032. Read together, plan on roughly the current exemption for four years of homestead, then the larger one. Starting January 1, 2030, a county or city may shorten that wait by a two-thirds vote if it finds a critical local need (Kaufman Rossin; Florida Chamber).
The difference depends on value and millage. WGCU reported an online estimator projecting about $1,736 in 2028 savings on $400,000 of Lee County taxable value at 2025 millage (WGCU, October 15, 2026). Over four years that is worth planning around, but it should not push you into the wrong house.
Can my former state still tax me after I move?
It can try. A former home state can challenge a Florida residency claim, especially for high earners, so your facts need to match your paperwork.
Kaufman Rossin notes that New York's residency audits weigh your home, active business ties, time spent, items "near and dear," and family connections, and that a Florida license and voter registration do not settle the question on their own. A filing that gets ahead of the facts can cost more in income tax than it saves in property tax. If you are leaving a high-tax state, see a CPA or tax attorney before December and keep moving receipts and your lease or closing statement.
What is still undecided about the residency rule?
How "permanent residency" will be proven, and whether every detail survives legal review, is not settled. Gov. DeSantis said on November 4, 2026 that he will call a special session within about two months to implement Amendment 3 (Florida Realtors, November 5, 2026).
The vote is unofficial until certified. The residency rule applies "to the extent permitted by the U.S. Constitution," and no post-election lawsuit had been reported as of November 6, 2026. The 2027 regular session, March 2 to April 30, may add procedures (Kaufman Rossin). I will update this page after the special session.
Frequently asked questions
What is the Florida residency deadline for Amendment 3?
December 31, 2026. People who are permanent Florida residents on or before that date qualify for the larger homestead exemption when they homestead a home: up to $150,000 of assessed value exempt from non-school taxes in 2027 and $250,000 in 2028. People who become residents on or after January 1, 2027 start smaller and reach the larger exemption in their fifth year of homestead, per the Leon and Volusia County Property Appraisers.
Do I need to close on a house before December 31, 2026?
Not under the Leon and Volusia County Property Appraisers' reading, which says residency by December 31 is the test and a later purchase still qualifies. Some sources tie the date to having homestead property, so closing and moving in by December 31 is the most protective plan. It also lets you file for the 2027 homestead exemption by March 1, 2027. Confirm with the Lee or Collier County Property Appraiser.
How long do I have to get a Florida driver license after moving?
Thirty days. FLHSMV says new residents must get a Florida driver license within 30 days of establishing residency and must title and register their vehicles within 10 days, after getting Florida insurance. In Lee and Collier, both are handled by the county Tax Collector, which recommends appointments. Vehicles new to Florida pay a one-time $225 initial registration fee under section 320.072.
What is a declaration of domicile in Florida?
A declaration of domicile is a sworn, notarized statement filed with the county Clerk of the Circuit Court under section 222.17 of the Florida Statutes, declaring that Florida is your permanent home. It lists your current address and where you lived before. It supports a residency claim and dates your intent on the public record, but it does not replace a Florida license, vehicle registration or voter registration.
Does renting in Florida by December 31 count?
The Leon and Volusia County Property Appraisers say a person who is a permanent Florida resident by December 31, 2026 and buys later, such as a renter who buys in 2027 or 2028, qualifies for the higher amount when applying for homestead. Keep your lease, Florida license, vehicle registration and voter registration dated before December 31. Implementing legislation could still add proof requirements.
When is the homestead filing deadline for 2027?
March 1, 2027. To receive the 2027 homestead exemption, you must own the home and live in it as your permanent residence on January 1, 2027, then file Form DR-501 with the Lee or Collier County Property Appraiser by March 1. Lee accepts online filing at leepa.org. If you are moving a Save Our Homes benefit from another Florida homestead, file the portability form at the same time.
Will the special session change the December 31 rule?
It could add details. Gov. DeSantis said on November 4, 2026 that he will call a special session within about two months to implement Amendment 3, and the 2027 regular session runs March 2 to April 30, 2027. Procedures for proving permanent residency are among the open items. The December 31, 2026 date itself is in the amendment voters approved, which is unofficial until certified.
